Clerical Error Leads to Additional Proposition

In December 2018, the Liverpool Central School DistrictThe Liverpool Central School District globe logo. asked voters to reauthorize the Phase Three Capital Project after the major component of the project – the renovations at Liverpool High School - came in $10 million over budget.

After discussing its options and making significant changes, the district was informed that an additional $5.8 million would be required in order to complete all phases of the capital project. So, the district went back to the community and asked voters to approve the revised Phase Three Capital Project at a new combined maximum estimated cost of $45,281,107 and to withdraw an additional $950,000 from the district’s 2009 Capital Reserve Fund (at no additional cost to the community).

While the community overwhelming approved the use of additional funds for the project, the district discovered – after the vote - that the capital reserve fund referred to in the December proposition was incorrect – the correct fund should have been the 2016 Capital Reserve Fund (not the 2009 Capital Reserve Fund).

The district reached out to New York State Commissioner of Education MaryEllen Elia with a formal appeal and asked that the error be identified as a clerical error, however the commissioner ruled that voters did not approve the utilization of funds from the appropriate capital reserve fund and the district is obligated to re-vote the re-authorization request.

On May 21, Liverpool voters will be presented with an updated proposition (Proposition #2 on the ballot) to reauthorize the Phase Three Capital Project with the appropriate capital reserve fund listed in the proposition.

Proposition No. 2 will read:

“Shall the Board of Education of the Liverpool Central School District (the “District”) be authorized to reconstruct, improve, rehabilitate, repair, furnish and equip the Wetzel Road Elementary School, Liverpool High School and the District Transportation Center, including site work, at a new combined maximum estimated cost of $45,281,107 and to raise an additional sum of $5,800,000 by (a) the appropriation of an additional $950,000 from the District's 2016 Capital Reserve Fund to pay a portion of said costs; and (b) the levy of a tax upon the taxable property of the District, to be collected in annual installments as provided in Section 416 of the Education Law, which tax may be offset by New York State aid available therefore; and, in anticipation of such tax, shall the District be authorized to issue obligations of the District up to a maximum principal amount of $4,850,000?”

The annual LCSD Budget Vote and Board of Education Election will take place on Tuesday, May 21, from 6 a.m. to 9 p.m. in the former Wetzel Road Elementary gymnasium. Follow the signs along Wetzel Road to locate the correct entrance and parking lot.
